When someone dies through the negligent act of another, a wrongful death claim can result. In a wrongful death case, the personal representative of the estate of a deceased person is authorized to file a lawsuit again those responsible for the person’s death. When an insurance company fails to provide benefits under an insurance policy, the terms of the policy must be examined very closely to determine whether the insurer is reasonable in its actions. If not, the insured may be able to bring a bad faith lawsuit to recover economic losses caused by the insurer’s actions, even if they exceed the policy limits, as well as compensation for emotional distress, and even in some cases punitive damages.
